Terms of Service

AJATransindo Vehicle Rental Agreement (Ijarah Contract)

Preamble

All praise is due to Allah, the Lord of the worlds. This Agreement is established upon the principles of mutual consent (an-tarāḍin) and trust (amānah). By accessing and using the services of AJATransindo, you (the “Renter”) agree to be legally bound with us (AJATransindo / PT AJTrans) under a valid Ijarah (rental) contract, enforceable under applicable laws and in accordance with Sharia principles.

Article 1 – Eligibility and Registration

  1. Legal Capacity: The Renter must be at least eighteen (18) years of age, mentally competent, and in possession of valid government-issued identification (ID Card or Passport) as well as a valid Driver’s License (SIM A).

  2. Mandatory Registration: All customers must be duly registered within AJATransindo’s official management system. Services are provided exclusively to individuals who have successfully completed identity verification procedures to ensure asset security and transactional integrity.

  3. Membership Classification (Regular Member): Standard services are available to customers registered as Regular Members (Non-VIP). Such status constitutes the minimum requirement to access AJATransindo’s fleet.

  4. VIP Membership: VIP Membership is granted as a form of appreciation to customers demonstrating high levels of integrity and loyalty. This membership is strictly personal and non-transferable without prior written consent from AJATransindo.

Article 2 – Rental Object and Permitted Use

  1. Condition of Vehicle: Vehicles (including Ertiga and XL7 Hybrid units) are delivered in good, clean, and roadworthy condition. The Renter is responsible for inspecting the vehicle upon handover.

  2. Lawful and Sharia-Compliant Use: The Renter is strictly prohibited from using the vehicle for any unlawful activities under the laws of the Republic of Indonesia or activities contrary to Islamic principles, including but not limited to the transportation of prohibited goods, gambling, or immoral conduct.

  3. Territorial Restrictions: Use of the vehicle is restricted to the agreed operational area. Any use outside the designated area without prior authorization shall constitute a breach of trust and may result in administrative penalties.

Article 3 – Fees, Liability, and Compensation

  1. Pricing Policy: All agreed rental fees, including any VIP upgrade packages, are final and binding. AJATransindo maintains a strict no-hidden-fee policy in the interest of transparency.

  2. Liability (Dhaman): As the entrusted party, the Renter assumes full responsibility for any loss or damage to the vehicle arising from negligence (taqṣīr) during the rental period.

  3. Vehicle Cleanliness: To ensure comfort and uphold shared values, smoking and the presence of pets within the vehicle are strictly prohibited. Violations will result in the imposition of a cleaning fee.

Article 4 – Cancellations and Delays

  1. Late Return: Timely return of the vehicle is required. Late returns without prior notice shall incur compensation charges due to the loss of rental opportunities for other customers.

  2. Cancellation Policy: Any unilateral cancellation by the Renter must be communicated promptly to minimize disruption to operational management.
